Crimes Against Humanity

The term crimes against humanity has come to mean anything atrocious committed on a large scale. This is not, however, the original meaning nor the technical one. The term originated in the 1907 Hague Convention preamble, which codified the customary law of armed conflict. This codification was based on existing State practices that derived from those values and principles deemed to constitute the "laws of humanity," as reflected throughout history in different cultures.

After World War I, the Allies, in connection with the Treaty of Versailles, established in 1919 a commission to investigate war crimes that relied on the 1907 Hague Convention as the applicable law. In addition to war crimes committed by the Germans, the commission also found that Turkish officials committed "crimes against the laws of humanity" for killing Armenian nationals and residents during the period of the war. The United States and Japan strongly opposed the criminalization of such conduct on the grounds that crimes against the laws of humanity were violations of moral and not positive law.

In 1945, the United States and other Allies developed the Agreement for the Prosecution and Punishment of the Major War Criminals of the European Axis and Charter of the International Military Tribunal (IMT), sitting at Nuremberg, which contained the following definition of crimes against humanity in Article 6(c):

Crimes against humanity: murder, extermination, enslavement, deportation, and other inhumane acts committed against civilian populations, before or during the war; or persecutions on political, racial or religious grounds in execution of or in connection with any crime within the jurisdiction of the Tribunal, whether or not in violation of the domestic law of the country where perpetrated.

The Nuremberg Charter represents the first time that crimes against humanity were established in positive international law. The International Military Tribunal for the Far East, at Tokyo, followed the Nuremberg Charter, as did Control Council Law No. 10 of Germany, under which the Allies prosecuted Germans in their respective zones of occupation. Curiously, however, there has been no specialized international convention since then on crimes against humanity. Still, that category of crimes has been included in the statutes of the International Criminal Tribunal for the Former Yugoslavia (ICTY) and the International Criminal Tribunal for Rwanda (ICTR), as well as in the statute of the International Criminal Court (ICC). In fact, there are eleven international texts defining crimes against humanity, but they all differ slightly as to their definition of that crime and its legal elements. However, what all of these definitions have in common is:

  1. they refer to specific acts of violence against persons irrespective of whether the person is a national or nonnational and irrespective of whether these acts are committed in time of war or time of peace, and
  2. these acts must be the product of persecution against an identifiable group of persons irrespective of the make-up of that group or the purpose of the persecution. Such a policy can also be manifested by the "widespread or systematic" conduct of the perpetrators, which results in the commission of the specific crimes contained in the definition.

The list of the specific crimes contained within the meaning of crimes against humanity has been expanded since Article 6(c) of the IMT to include, in the ICTY and the ICTR, rape and torture. The statute of the ICC also expands the list of specific acts. In particular, the ICC statute adds the crimes of enforced disappearance of persons and apartheid. Further, the ICC statute contains clarifying language with respect to the specific crimes of extermination, enslavement, deportation or forcible transfer of population, torture, and forced pregnancy.

To some extent, crimes against humanity overlap with genocide and war crimes. But crimes against humanity are distinguishable from genocide in that they do not require an intent to "destroy in whole or in part," as cited in the 1948 Genocide Convention, but only target a given group and carry out a policy of "widespread or systematic" violations. Crimes against humanity are also distinguishable from war crimes in that they not only apply in the context of war-they apply in times of war and peace.

Crimes against humanity have existed in customary international law for over half a century and are also evidenced in prosecutions before some national courts. The most notable of these trials include those of Paul Touvier, Klaus Barbie, and Maurice Papon in France, and Imre Finta in Canada. But crimes against humanity are also deemed to be part of jus cogens-the highest standing in international legal norms. Thus, they constitute a non-derogable rule of international law. The implication of this standing is that they are subject to universal jurisdiction, meaning that all States can exercise their jurisdiction in prosecuting a perpetrator irrespective of where the crime was committed. It also means that all States have the duty to prosecute or extradite, that no person charged with that crime can claim the "political offense exception" to extradition, and that States have the duty to assist each other in securing evidence needed to prosecute. But of greater importance is the fact that no perpetrator can claim the "defense of obedience to superior orders" and that no statute of limitation contained in the laws of any State can apply. Lastly, no one is immune from prosecution for such crimes, even a head of State.

I am getting ready to charge my community -Monadnock region of NH and NH itself -with "crimes against humanity" and "state sponsored systemic terrorism" against the disabled. You understand I am not charging the politicians and bureaucrats with these ghastly crimes -I am going to charge all of the good people of the community with knowingly abusing the disabled -to knowingly keeping the abuses hidden from the public's eyes because of economic self interest -low taxes.

PICKING UP THE PIECES

After years of administrative neglect and budgetary malnutrition, elected officials must finally end their abuse of Texas Child Protective Services

It's taken more than 500 deaths of abused children in Texas over the past 2 1/2 years to awaken the public and their representatives to the grievous consequences of slashing the budget of the agency entrusted with protecting those kids. Now it seems every political figure in Austin is shocked, truly shocked, and ready to free up hundreds of millions of dollars to address the problem.

"The system is obviously broken," Lt. Gov. David Dewhurst said. "It's outrageous. It's heartbreaking. It's unacceptable. And we must fix it."
Gov. Rick Perry has made CPS reform his top priority in this legislative session after commissioning an investigative report in the wake of an indictment of the agency by an Hidalgo County grand jury.

State Comptroller Carole Keeton Strayhorn issued her own critical report on foster care last year, which found child abuse by approved foster parents and overuse of psychiatric medications to control children.

When so many elected officials suddenly agree there's a crisis, one has to wonder where they all were when the funding for Child Protective Services was repeatedly cut, creating the current emergency. As the Chronicle's Terri Langford reported, that process began in 1995 when more than 600 clerical and case technician positions were eliminated from the agency.

CPS investigators depend on staff assistance to maintain mandatory case records. When a technician is not available to transcribe caseworker dictation, that forces the worker to divert time from directly assisting clients and investigating abuse reports. That in turn feeds into growing caseload backlogs, which have now reached an average of 75 per investigator across the state and more than 100 in San Antonio. Those unworkable caseloads create burnout and rapid turnover among investigators. With a cycle like that, no one should be surprised when children fall through the cracks and end up neglected or worse as a result.

The case that caught Gov. Perry's attention occurred last year in South Texas, where lax CPS supervision allegedly allowed a stepfather to abuse three daughters. That led the Hidalgo County grand jury to return three felony indictments against the Department of Family and Protective Services, which runs CPS. The district attorney refused to file charges, explaining there was no practical way to prosecute a state agency. Other recent high-profile abuse cases include a 2-year-old girl beaten to death in San Antonio; a young boy starved to death in Arlington; and an infant fatally mutilated by a Plano mother. In all of these cases, CPS was criticized for not acting in time to save the youngsters.

Perry's report calls for an additional $329 million CPS budget increase over two years and nearly 850 additional investigators statewide. Their goal would be to reduce caseloads per worker from 75 to 45 and lower response times for some abuse calls from 10 days to 72 hours. The budget increase would also create an office of investigations that would apply law enforcement and forensic tools to CPS probes.

These are minimal steps to address a horrible situation that Texas lawmakers must take some responsibility for having created. No less than a foster parent responsible for nurturing a child, lawmakers who starve an agency cannot then express surprise at the results. The real tragedy is that in order to save children from abuse in this state, it has taken so many deaths to point the way.

The ageless hope of Viginia Lee Burton to her children

Of course I like the idea of what a kid’s story means to you –not necessarily about what the author meant it to be.

We know that Virginia comes from a very educated Ivy League family: MIT and Harvard. My bet was Virginia very plugged into our culture at the time –and she was very aware of what was going on in the depression. So was she trying to tell a little story to her child explaining what was going on with the depression –and the ending of the story, was she trying to tell her son Michael that in any horrific event such as the depression –there can be a happy ending.

My bet she was writing up and sketching this story for two years prior to the copy write –that brings us to 1937. This was the year that we were seeing the second downward leg of the depression. We were still in very high unemployment and the economy disvalued worker wages at this time. So, was she trying to tell her kids about working harder and harder for less –with the economy not valuing the human spirit, which pushes us into mistakes -much family and national anger and infighting –that no matter how hopeless it looks like today –it will all end up in the happy story with everyone living in a comfortable job and living situation.

Was she trying to give her kids hope in those disparate times through the story of mike mulligan and the steam shovel–give all of our kids the message of hope in those truly horrible times?

You will note that Germany, Great Britain and then the USA drove themselves out of the depression through deficit spending; they all had to create the ideology of hate and extreme nationalism in order to justify deficit spending in military hardware in preparation to war. So we got a huge failure in the global economic system ending in global war. Right, the political leaders would rather instigate a war with another country than have the public blame the politicians for the economic damage because of a failure of leadership.

So you now understand the political necessity for all wars!

What you got to do not is to effectively create funny money on a grand scale –a global federal reserve. What we’ve got to do is create a massive global public works program on a scale the world has never seen before –you got to create a planetary educational system and you’ve got to create planetary infrastructure and energy modernization program. You got to drive the whole world into security and stabilization with all of our common needs.

You know you crazy ass people are going to spend the money anyway –either in the machines and instruments of war, death and destructions –or you are going to have to give Hope to the world that there is going to be a good future.

So where are the ideals of Virginia Lee Burton today?

I was born on August 30, 1909, in Newton Center, Massachusetts. My mother was English, a poet and a musician. My father was the dearly beloved Dean Burton of the Massachusetts Institute of Technology . . . their first dean and only dean until he retired in 1921.
My memories of early childhood in Newton Corner consist of English folk songs and English folk dancing around a Maypole . . . celebrating Twelfth Night when everyone dressed up in costumes and the neighbors came in to sing and dance and "wassail" the old apple trees. On other holidays our parents put on marionette shows for us and our friends. Our old barn was converted into a school, and I believe the first Montessori System in this country was taught there. Dad, instead of giving us toys for birthdays and Christmas, gave us beautifully illustrated children's books, which he would read aloud to us. I am sure my interest in picture books stemmed from this.
We lived in Newton Corner until I was about eight. The New England winters were getting to be too much for my mother's health, and as it was about time for my father to retire, we moved to California. We stayed one year in San Diego and then moved up the coast to Carmel-by-the-Sea. Carmel was then a simple unspoiled small town inhabited by retired and semi-retired artists, writers, and musicians. There were three theaters and a little old two-room schoolhouse. Always there was a play or an operetta in rehearsal going on and everybody took part. To be sure it was all amateur, but it was a lot of fun. My sister and I loved dancing and studied at every opportunity (of which there were many) and appeared in the local productions.
When I was sixteen and a junior in high school, where there was a good art teacher, I happened to win a state scholarship to the California School of Fine Arts in San Francisco. In my senior year I was editor of the school annual and, on the side, started a dancing class of my own.

Aristides Burton Demetrios, Virginia Lee Burton’s oldest son, is a renowned contemporary sculptor whose works can be seen throughout the United States and elsewhere around the world. Educated at Harvard University in history and literature, Demetrios later studied sculpture with his father, George Demetrios, in Gloucester, Massachusetts. Since then, he has worked with the some of the nation’s leading designers (Thomas Church, Lawrence Halprin, Peter Walker, Ken Kay, Peter Calthrope, and Michael Taylor) to create bronze fountains and sculptures, large scale outdoor stainless steel sculptures, and painted steel sculptures commissioned for public pavilions, private residential gardens, and corporate facilities. Demetrios also exhibits his work in galleries throughout the United States. He is currently an artist-in-residence at the University of California, Santa Barbara.
Michael Burton Demetrios was born on August 30, 1935 in Groton, Massachusetts. When he was four, Virginia Lee Burton dedicated Mike Mulligan and His Steam Shovel to him and he served as the model for the little boy who helps Mike and Mary Anne dig the cellar in one day. A graduate of Harvard Business School, Demetrios was the president of Marine World Africa USA for more than twenty years. While president, Demetrios, together with a group of businessman, purchased the park from Resorts International and successfully relocated to Vallejo, California. Now, Marine World Africa USA is a world class facility and has reached annual attendance levels of 1.9 million. Since January 1998, Demetrios has served as President of Intra-Asia, a US Company with two amusement parks in China and plans to have five additional parks. He travels extensively throughout China and sees this as an "exciting and fascinating time to be doing business with China". Michael Demetrios lives outside of Los Angeles.

1929
Herbert Hoover becomes President. Hoover is a staunch individualist but not as committed to laissez-faire ideology as Coolidge.
More than half of all Americans are living below a minimum subsistence level.
Annual per-capita income is $750; for farm people, it is only $273.
Backlog of business inventories grows three times larger than the year before. Public consumption markedly down.
Freight carloads and manufacturing fall.
Automobile sales decline by a third in the nine months before the crash.
Construction down $2 billion since 1926.
Recession begins in August, two months before the stock market crash. During this two month period, production will decline at an annual rate of 20 percent, wholesale prices at 7.5 percent, and personal income at 5 percent.
Stock market crash begins October 24. Investors call October 29 "Black Tuesday." Losses for the month will total $16 billion, an astronomical sum in those days.
Congress passes Agricultural Marketing Act to support farmers until they can get back on their feet.
1930
By February, the Federal Reserve has cut the prime interest rate from 6 to 4 percent. Expands the money supply with a major purchase of U.S. securities. However, for the next year and a half, the Fed will add very little money to the shrinking economy. (At no time will it actually pull money out of the system.) Treasury Secretary Andrew Mellon announces that the Fed will stand by as the market works itself out: "Liquidate labor, liquidate stocks, liquidate real estate… values will be adjusted, and enterprising people will pick up the wreck from less-competent people."
The Smoot-Hawley Tariff passes on June 17. With imports forming only 6 percent of the GNP, the 40 percent tariffs work out to an effective tax of only 2.4 percent per citizen. Even this is compensated for by the fact that American businesses are no longer investing in Europe, but keeping their money stateside. The consensus of modern economists is that the tariff made only a minor contribution to the Great Depression in the U.S., but a major one in Europe.
The first bank panic occurs later this year; a public run on banks results in a wave of bankruptcies. Bank failures and deposit losses are responsible for the contracting money supply.



Supreme Court rules that the monopoly U.S. Steel does not violate anti-trust laws as long as competition exists, no matter how negligible.
Democrats gain in Congressional elections, but still do not have a majority.
The GNP falls 9.4 percent from the year before. The unemployment rate climbs from 3.2 to 8.7 percent.
1931
No major legislation is passed addressing the Depression.
A second banking panic occurs in the spring.
The GNP falls another 8.5 percent; unemployment rises to 15.9 percent.
1932
This and the next year are the worst years of the Great Depression. For 1932, GNP falls a record 13.4 percent; unemployment rises to 23.6 percent.
Industrial stocks have lost 80 percent of their value since 1930.
10,000 banks have failed since 1929, or 40 percent of the 1929 total.
About $2 billion in deposits have been lost since 1929.
Money supply has contracted 31 percent since 1929.
GNP has also fallen 31 percent since 1929.
Over 13 million Americans have lost their jobs since 1929.
Capital growth investments have dropped from $16.2 billion to 1/3 of one billion since 1929.
Farm prices have fallen 53 percent since 1929.

1933
Roosevelt inaugurated; begins "First 100 Days" of intensive legislative activity.
A third banking panic occurs in March. Roosevelt declares a Bank Holiday; closes financial institutions to stop a run on banks.
Congress authorizes creation of the Agricultural Adjustment Administration, the Civilian Conservation Corps, the Farm Credit Administration, the Federal Deposit Insurance Corporation, the Federal Emergency Relief Administration, the National Recovery Administration, the Public Works Administration and the Tennessee Valley Authority.
Congress passes the Emergency Banking Bill, the Glass-Steagall Act of 1933, the Farm Credit Act, the National Industrial Recovery Act and the Truth-in-Securities Act.
U.S. goes off the gold standard.

The economy turns around: GNP rises 7.7 percent, and unemployment falls to 21.7 percent. A long road to recovery begins.
Sweden becomes the first nation to recover fully from the Great Depression. It has followed a policy of Keynesian deficit spending.
1935
The Supreme Court declares the National Recovery Administration to be unconstitutional.
Congress authorizes creation of the Works Progress Administration, the National Labor Relations Board and the Rural Electrification Administration.
Congress passes the Banking Act of 1935, the Emergency Relief Appropriation Act, the National Labor Relations Act, and the Social Security Act.
Economic recovery continues: the GNP grows another 8.1 percent, and unemployment falls to 20.1 percent.
1936
The Supreme Court declares part of the Agricultural Adjustment Act to be unconstitutional.
In response, Congress passes the Soil Conservation and Domestic Allotment Act.
Top tax rate raised to 79 percent.
Economic recovery continues: GNP grows a record 14.1 percent; unemployment falls to 16.9 percent.
Germany becomes the second nation to recover fully from the Great Depression, through heavy deficit spending in preparation for war.
1937
The Supreme Court declares the National Labor Relations Board to be unconstitutional.
Roosevelt seeks to enlarge and therefore liberalize the Supreme Court. This attempt not only fails, but outrages the public.
Economists attribute economic growth so far to heavy government spending that is somewhat deficit. Roosevelt, however, fears an unbalanced budget and cuts spending for 1937. That summer, the nation plunges into another recession. Despite this, the yearly GNP rises 5.0 percent, and unemployment falls to 14.3 percent.
1938
Congress passes the Agricultural Adjustment Act of 1938 and the Fair Labor Standards Act.
No major New Deal legislation is passed after this date, due to Roosevelt's weakened political power.
The year-long recession makes itself felt: the GNP falls 4.5 percent, and unemployment rises to 19.0 percent.
Britain becomes the third nation to recover as it begins deficit spending in preparation for war.
1939
GNP rises 7.9 percent; unemployment falls to 17.2 percent.
The United States will begin emerging from the Depression as it borrows and spends $1 billion to build its armed forces. From 1939 to 1941, when the Japanese attack Pearl Harbor, U.S. manufacturing will have shot up a phenomenal 50 percent!
The Depression is ending worldwide as nations prepare for the coming hostilities.
World War II starts with Hitler's invasion of Poland.
1945
Although the war is the largest tragedy in human history, the United States emerges as the world's only economic superpower. Deficit spending has resulted in a national debt 123 percent the size of the GDP. By contrast, in 1994, the $4.7 trillion national debt will be only 70 percent of the GDP!
The top tax rate is 91 percent. It will stay at least 88 percent until 1963, when it is lowered to 70 percent. During this time, America will experience the greatest economic boom it has ever known.



The Al-Qaeda strategy...

Believe me the next planet wide tsunami will be when Saudi Arabia and OPEC benchmarks the value of a barrel of oil away from the dollar! Its right around the corner and the result will be a Pearl Harbor of a different type. Watch what the value of the dollar does then.

The Al-Qaeda strategy to destabilize the planet

I think Iraq and 9/11 are just a diversion. I think Ben Laden recognizes that if he hit the USA too many times as in 9/11, this would stimulate the military strengthening of us –and our reorganization.

So I think on one side he is trying to stimulate our dysfunctional government into making enormous unproductive spending and the political payoffs as seen by the homeland security –but not enough to be really effective. He knew this would all come down to selfish self interest of our political establishment. So on the other side he wants to increase the world hated of us –with the primary task of distancing us from our foreign energy sources –this is truly a long term strategy.

So as peak oil digs in –the world will withhold energy sources to us. So in an example would be in Russia –where the Russians are diverting energy sources towards China. So I think the fastest collapse of the USA could come from an energy crisis as seen in the USA. Take Laden’s strategy of Saudi Arabia –that’s to disconnect the west from that oil. So the world hates us more and more now –I think these countries will more and more disconnect us from our energy sources –much like we disconnected oil from the Japanese prior to WWII.

So an energy crisis would lead to an enormous financial crisis as seen throughout the planet -remember our governmental and individual debt—this would lead to a historic planetary reorganization away from America.

I think the Saudi Arabia model is very telling –we are so dependant on their financing and resources –that they are blackmailing us –such that we can’t respond to their attempts to slowly destabilize us ---threats of withdrawing oil from the markets, which has frozen our national policy because we are too afraid to act because of the threatening consequences.

I think that is the planetary model to us now, where our dependence on our needs coming from foreign sources; trade…debt financing… energy resources, with our political fear of the huge consequences with the organized withdrawal of these resources creating a collapse –has frozen us from taking any action which could mitigating these threats in the future.

What we are going to find out in the future –is how all of our trade agreements have destabilized us in the long term –with making a very small majority of us rich beyond imagination and undermining the take home pay of millions of us. We too much fear the world’s backlash against us now –such that we can’t act in our national interest.

Every one of them had sold us down the river for individual profits!

Lynx,

I still think you are a genius –you are struggling to use your intellect to put me down. If your were the real thing, you’d find a way to raise me up no matter what my sins and defects are. You would know that my sins are the greatest tools of the universe in helping me make my move towards enlightenment –and my faults and failures have the power to interact with the world around me. I am telling you it’s a perfect system –and you can’t go the wrong way. Take a look at the early apostles –some of these people weren’t nice men.

So you put your money in the pot –why and what’s your angle. Of all the people in the world why do you pay so much attention to me?

Of course Jesus Christ was the biggest bum on the planet in his days. He stole fruit from other people’s hard work and from their farms. Most of the world hated him.

Of course when you are a bum, when you have disconnected yourself from many aspects of the world, your pride, peoples opinion of you, of not adequate pay and benefits…Well, you are then sitting on the edge of tremendous creativity without any attachments. Here is my prayer to the universe.

Old dear god of the universe make my life a stinking rotten smelly sore. I am taunting you –you don’t have the courage or the strength to do it. I dare you too take everything away from me –make me starve, take my family away from me –make me sleep to the streets, let me watch terrible suffering of the innocent people around me –take away all of my dignity, my hopes and dreams –have everyone spit on me, urinate, throw feces on me, beat me, cut and mutilate me…

I then will be in the environment that where I feel most comfortable with. In those moments, you know you will see the tinkle in my eye. I will never give up–you know that I will have the most power and be at my creative best. Come on god, have faith in me as I have faith in you. You know I will figure out a way to drag the whole world into these problems --and by that they will see you. What are you afraid of? Come on they will see divine aspects in me of you. You know it’s in all of us to mirror your divine aspects here on this planet.

Oh dear god make my life a miserable stinking rotten mess… I’ll show them you…

Make me the Pope!

I wouldn’t lose the teachings of the past –but I’d turn every Catholic Church into a moral and ethical gateway for advance technological creativity.

All of the priest and church bureaucrats would be continually educated with sitting on the modern cutting edge of management and technological innovation -they’d be educated on all of the sub atomic, quantum mechanics, genetic engineering, the internet, computing, IT, space time and travel, medicine, and how our brains work..... All of the churches would be wired up in the most advanced manner. The churches architecture would represent the gifts of future modernity –not death as we now worship.

I mean all of the governments, bureaucracies and corporation would beat a path to the churches doors knowing the church has the cutting edge answers, or better yet the questions –within the planets most advanced ideas of human integrity, freedom, ethics, truth, scientific evidence, technological advancements… I mean the church would be the conduit of transparency with moral modernity accessible on any place on this planet…

Did you catch what they are talking about in Texas? I mean man, highways of the future...

They are talking about overlaying and embedding a completely new architecture on our idea of our current interstates and highways. These would be mega pathways with huge highway travel lanes, separate travel lanes for cars and trucks, new train tracks for passenger and commerce –and in the center would be electrical grid lines, internet lines, gas and petroleum pipelines, and all of the rest. I guess all of these infrastructures would be buried. Could you make it ecstatically pleasing with grasses and trees…absolutely?

I mean when all of this is built –can you imagine what our creativity could add to this.

Now that is sexy!

Mike Mulligan is extremely proud of his great friend and steam shovel, Mary Anne. In fact, he believes that she is as strong as one hundred men. Unfortunately it's getting harder and harder for Mike and Mary Anne to find work - the new diesel and nuclear shovels have been taking all the excavating jobs.When Mike discovers an opportunity to dig the foundation for Popperville's new city hall, he and Mary Anne go there immediately. As they arrive in Popperville, they discover many different kinds of shovels have already arrived for thejob and a bidding will be held to determine who will get it. The bidding will be officiated by one of the selectmen, Henry B.Swap. Mr. Swap goes out of his way to belittle Mary Anne and Mike because they are not up-to-date. As the other shovels appear for the bidding, Mike and Mary Anne realize they have their work cut out for them. To prepare Mary Anne for the bidding, Mike decides to go into town and buy some polish to make her look as clean as possible.While Mike is purchasing the polish, the bidding goes on without him. Mary Anne is left to bid and she become very discouraged as she meets her competition - the Diesel, Electric, and Nuclear shovels. Each has a lot of power and can perform tricks that MaryAnne just can't. Henry B. Swap is very impressed with each of the three shovels' performances. By the time Mike Mulliganre turns, the Nuclear Shovel has won the bidding, by promising to dig the foundation in three days for $3,000. Still determined that he and Mary Anne are the best duo for the job, he asks Henry B. Swap if he can enter one last bid. He and Mary Anne will dig the foundation in one day and if they can't do it, then Mr. Swap can keep Mary Anne for his scrapyard. Henry B. Swap can't refuse the offer, and Mike and Mary Anne are awarded the job.The next day, Mike and Mary Anne start early in the morning: "Crowd. Hoist. Swing." Towns people and kids come to cheer them on. As more and more people come, Mike and Mary Anne work harder and harder. In the middle of the dig, MaryAnne's spring breaks and Mr. Swap announces that she and Mike can't finish the job. Luckily, a young lady watching finds aspring and with Mike's handiwork, Mary Anne gets up and running again. Mike and Mary Anne finish the job by their deadline. Unfortunately, they are faced with one more problem - Mary Anne is stuck in the new hole. A young man has a great idea: leave Mary Anne in the basement to be the new town hall's furnace, and let Mike be the janitor there. Henry B. We should all mourn for what we are doing to the disabled --really what we are doing to ourselves

A Time to Mourn

“The world's generosity has indeed been amazing, but sometimes we use our compassion as a self-enveloping fog to obscure our view of the abyss. Somehow it's wrong to turn this event into a good-news story so we can all feel warm this holiday season. It's wrong to turn it into a story about us, who gave, rather than about them, whose lives were ruined. It's certainly wrong to turn this into yet another petty political spat, as many tried, disgustingly, to do.
This is a moment to feel deeply bad, for the dead and for those of us who have no explanation.”


I won’t be so generous –I think the media felt the public was going to get turned off from the bleak news of the tsunami; lost of viewerships and revenues. So they began trying to turn it into a more positive stories - a how we missed being one of the 150,000 dead bodies stories. The bureaucracy does this very same thing for the disabled.

You never see an accurate story about the troubles of the disabled. Many times they will want to write a story about the disabled –so they may go to an agency –the agency picks an individual who best reflect the agency. The story is played in the media as an individual who against grave odds is making it out in the community –and the negative to the story is this plateau of the individual is going to be challenged by the budget cuts. So the newspaper gets a sort of positive story such that it doesn’t knock down viewership, the private businesses and federal and state bureaucracies are protected from immorally of what they are really doing. Let’s not forget this allows the political establishment to be held unaccountable.

So the taxpayer would never be allowed to see a shitty and urine smelling house of a schizophrenic –where he has become medicated to such an extent that he can’t talk and control his going to the bathroom -because he has been troublesome for the private caregivers whose only interest is the extra income to the house. I’ve been in such a house –the exterior of the house was disgraceful compare to the typical homes of the neighborhood -the interior was a disgraceful dirty horror. But the leader of the house drove a new Cadillac. Everyone in the neighborhood knew what was going on—oh the silences of the good peoples.

So this was a private home and the man and woman were taking care of of this prior institutionalized man. The state rented a brand new car -where the staff drove the schophrenic man around NE from 7am to 4pm every day to get him out of the house, to keep him out of everyones hair. Talking about the man living in the chemical isolated and the majority of his time being isolated in his car. Of course the self interest was it was cheap for the state and it provided income for the household.

A private human service provider was contracted to take care of this indivegual. A state employee/bureaucrat was the Gardium Ad Lidom for the majority of these people. I never could understand how they tolerated such horrible conditions. Of course the highest priority in this for the employees is meeting the political priority of the state.

They had layer and upon layer of employees who overseen these people -and each higher level who had more power over the people, and was more disconnected to the day to day needs of the indivegual. It was intentionally set up like that. It was an employment service and polical jobs program. They had a corporate employee who overseen the quality of care -they had a huge local non profit who did the training on the human service employees and a whole department who overseen the quality of the disabled for this area -then you got to the state agencies ---and the you get all sorts fedural overseers who all have blinded themselves.

I was in interview with the top nonprofit executive -who overseen the local quality of care and did investigations for the region-I asked her how could you allow this to go on. She just looked at me with sad eyes(three layers of management ended up being fired or asked to leave).

So you see what's going on with the executives of the state, the contractors and local non profits(kind of an arm of the state human service agency) knew about the game of scape goating the lower level employees as problems came into the public view. So the "good peoples" were so protected and the employees who actually touched the disabled were extraordenarally vulnerable to a coverup and the widespread abuse of power of the establishment.

It was an enormous protections racket where all of the politicians, state agencies, the non profits, and the contractors created this system of protection to the higher ups -everyone knew the the state was creating a inhuman gulog of services to the disabled with not having enough resources-and they created an huge protection and racket sceme to protect the elites of the establishment from the known systemic abuse of the disabled . You understand what I am saying, they knew they were creating inhuman substandard care of the disabled -and they created a protection system for the known problems of the system.

People think I am nuts -but I thought they needed a United Nation Investigation with this. Don't kid yourselves its governmental; fedural and state sponsored terrorism against the disabled. Don't misunderstand what I am saying. I am not asking the UN to investigate our government and bureaucrocies related to the care of the disabled. I am asking the UN to investigate your known involvement with this inhumanity. That's right the public --you--you --you!

Now I am going to get into big trouble -the public -the good people of the community are the prime drivers with creating this gulog. The public has corrupted all of the government and the bureaucrocies -so where are you going to find justice here. God help you if you get into the system.

I took care of another individual. His septic leach field was leaking fluid down the front of his house (he lived by himself). I called the septic service many times to drain the tank in order to get the bathrooms to work. I would like to see the septic tank pumping bills? The leach field was gone and the state just couldn’t afford to replace it. Again his house was in terrible shape and deinstitutionalization has worked like a charm. I asked them to give me some paint -I will paint the interior of the house –but they couldn’t find the money. So they had $8.00 an hour untrained employees working 24 hours a day to take care of this seriously disturbed man -they went through employees like diarrhea.

So I created a situation where I got a state human service investigator to come see what was going on in the house. He interviewed a few employees and managers –he talked to me last. He made an appointment to see me up in the corporate office. I basically said, you and I know what is going on here –I been to a few disabled houses in the area –and it’s disgraceful in what I see with the adults. He told me his NH boss has told all of the investigators to downplay of the conditions of the disabled for political reasons. I said, by the way, seeing how you are investigating an individual who I was taking care of –have you visited his dirty filthy rotten house with no leach field. He told me he had no intention in visiting the house –he is driving back to Concord NH as soon as he is finished with me. I said the objective with me creating an investigation is to get you to eye-ball the house. I said how could this be? He told me he wasn’t going to visit the house…

So a private human service company overseen by many state and federal would never bring you to a house such as above –and the media would never have the guts to tell you the real story –such that for decade we’d (all of us) negligently have taken care of many individuals –and our lack of resources created appalling inhuman conditions and trapped the disabled into frozen lives of no growth or the great slide backwards.

So the newspaper people are generally in direct contact with the bureaucracies of the disabled -they know about the extreme poor pay of the employees and the seemingly heroic work of the managers –so why would we want to pick on these people. Besides, we can all get on this phony altruism thing of speaking for the disabled –we are such good people—and we do it for free– aren’t we such good people –we speak…speak…speak of the good thing we do for the disabled –and we let the majority of them live lives of disgrace…living in shit…and piss…indifference… and early death that is on all of our conscience. Yes my friends, we are such good people…we talk of such good things… we do for free to the disabled… oh we are so good… good…good...!

So the mechanism of the human service agency especially the higher mangers are to selectively frame the conditions in the best light to the managers –and it’s never to just to tell the plain truth to the public. In the end, these bureaucracies become nothing but employment services for the politically connected –and they provide astonishing little services to the disabled. Many good people for years end up walking on top of the pathetic frozen lives of the disabled screaming for help –they know their service provider doesn’t have the funds to humanly take care of the disabled. They know it’s wrong –but they have to have a job and they have to have the status from the high paying executive jobs…of course that is the top ethics and morality of our times.

This is extraordinarily dangerous for you in this way but you don’t realize it. I believe the public knows what is going on -there is no doubt about that. So the politician’s knows the public won’t vote for the appropriate levels of human services of the disabled when they get into the anonymity of the ballet box- they won’t vote for the budget increases for the disabled. So the smart politicians cause the bureaucracies to selectively frame the issues about disabled –they hire the bureaucrats of the agencies –and their job is to provide jobs for their friends and provide the selective information that the politicians need. So the public demands the politician’s to lie; telling us the disabled are in pretty good conditions, that we don’t have to vote for tax increases, and you shouldn’t bother our conscience by telling us the pathetic truth. So a politician who just wants to throw the light of truth on the conditions of the disabled, they wouldn’t get voted in office because the public knows in the end they would need to take money out of their children’s pockets. Would you feed your child sitting across the table –or would you feed a distant child who doesn’t have parents watching over them?

So at the heart of this is the public is demanding and training the politician’s to lie to them. The public never ask the question of; why we don’t have enough income to help the disabled and not take money out of our children mouths. We are all cowards! You see how they use our kids as leverage against doing what’s right. Oh keep your ears and eyes closed –you couldn’t take the truth. You can only pick on powerless children.

So in the end the middle and upper class pick on the disabled class who is least able to defend themselves –they steal money for these poor people. In the end, the good people of a country turn the potent instruments of government against the least capable of us –they create all sorts of subterfuges and political games of untransparency; such that we create the illusion that the disabled are living lives like the rich. Right, these people don’t have the capability create a voting block against us.

Right, if there is only one scarp of food left to ease your families hunger and your competitor is a mentally challenged individual -you are going to use all of your god given intellectual capabilities in order to feed your children -even if I have to let the disabled to slowly die on their own. You would create a blizzard false intellectual illusions in your bureaucrocies and media; such that that you can make believe the disabled have adequate resources ---and that creates the justification that it’s OK to steal food from them... and it OK to steal the breaths from them--- or create the seeds of killing them.

Isn’t that the free market? By the way I knew three children –by the age of 11 the family killed the conscience of all their children. All of these kids were institutionalized until they were 21 years old. Two of the kids are in jail now. That is $250,000 for three children for 10 years-and about $50,000 for two adults for 15 years –that’s 9 million dollars over 15 years..and it’s going to go on for a lot longer time. One of these boys lived in my house for 2.5 years. So where was the community in the forming years of these kids?

I frame it like this –we got this huge inverted black monolithic pyramid. It even reaches to the stars. The Downs Syndrome 15 year old boy who is dead is lying on the ground. The point of the huge pyramid is sticking through his innocent chest. The other end is sticking straight up and is blocking out the sight of the stars themselves. The pyramid represents all of us -all of the pressures that is distroying human lives - sucking the life out of this boy(s) for selfish self interested reasons –even under the phony cover of altruism!

It truly is the law of the jungle with those who are needy -you have created it!

I had to look up the definition of proletarian –though I heard it many times. Your truth intreges me here. Wow, I see it know you are brilliant. You captured it perfectly –although you tick me off a little because I think of myself as being proletarian. You have to admit I can’t write worth shit –but I seems to get peoples attention.

Of course intellect and intelligences gives us the ability to manipulate the rules and our material world around us to our own ends –it doesn’t say if we will do for any higher ends -either for power and any personal rewards.


It interesting you frame it as the engineers don’t have any faults, and labor drinks, smokes, likes the image of women and sleeps. I won’t deny that labor has a lot of personal defects –but I know that engineers and the elites have their fair share of human defects –like enron.

You you are using your high intellect to frame it selectively towards some unseen advantage of yours. My guest is you are in this drama triangle –where you want to organize the facts toward creating a power advantage in your so called philosophy. I mean, if we were all to agree with the rules of your game –this would leverage power towards your group.

But the best way to understand the system in it is to ask the question –the system is perfectly designed to create the problems of which you are seeing today. So if you are seeing disillusioned employees with contempt of the rules –why is the system creating that.

So why can’t we all be engineers!

Friends,
As you can imagine I find some of the publics’ comments on my blog as being highly offensive. I’ll tell you the truth, I am desperately trying to figure out how to delete these offensive comments. I had a few back and fourths with technical support –I can’t find the trash can on the comment post page to click on, although tech support says it is there. I am still working on trying to find the trash can and then using the delete button. Does anyone know how to delete comments -specific ones?

I can see where this is going. I am going to have to come up with a policy on making comments to my blog. I first though I would not allow anyone to make anonymous comments –but then thought what if somebody wanted to make an anonymous safety concern know to us. So now being anonymous is OK. Anyway I am thinking about what I am going to do with making offensive comments.

But then I think that you seeing and making judgments on offensive comments may be extraordinarily valuable. Sometimes when I am reading an offensive comment, especially when it’s about me, when the message has a ring of truth about me, if I get past the need to delete the message –then I begin wondering why the message bothers me –or hurts me. Pondering why a question hurts me, or when an event bothers me, has become so helpful to me. Many times my ego is involved in the hurt and I am confronting some sort of shield in me, and it’s not at all good for my effectiveness.

So when I now feel hurt or when I see a disagreeable event around me, instead of pulling in, I see it as a signal to begin paying attention, to stick with the pain until I understand why it pains me. Being hurt is good! So when I feel hurt, I think about it a lot, I get to the point that this feeling of hurt is an exaggerated feeling in me, the instinctual reaction to the feelings of hurt has become extremely dysfunctional to my greater goals of what I am trying to do. I kind of transform the feeling of being hurt into the feeling of empathy, I kind of empathize with my exaggerated feelings in me –and I can even empathize better with the message maker because it doesn’t hurt me a much as it did in the past.

Most people just count to 10 without all the thinking as me –and it works just a well as my way of doing things.

So that would be my sole justification of not deleting a disturbing message. Though many time I can't get past the instinctual feels and I just hit the delete button -but you don't grow this way.

Please hurt me some more!

Graduating and "Aging Out" of a children’s mental institution

I heard this from an employee at this institution for the disabled –he took part in it.

We had this child who turned into a man –many years at the facility –he was being “aged out” of the facility. This guy had an extreme anger problem and was mentally disabled. His parents couldn’t take care of him and no other facility and group home would take care of this man. This guy hurt many of the staff members of the facility through the years.

I guess this has become a well worn procedure. They would take him to an emergency room of a hospital and try and get him a psychological admittance. Of course they wouldn’t tell the man that’s what they were doing. So they would fill out the admittance forms and bring all of his medical records with them. They knew the hospital couldn’t and wouldn’t admit this person.

So after the decline by the hospital, the case workers and institutional employees would just sit down in the emergency waiting room. They knew the man would end up getting bored –and thus he would eventually have a temper tantrum. There would be a lot of screaming, foot stomping, throwing furniture and maybe a punch or two (just another day for the employees) –with the institutional employees told not to get involved.

So the hospital police would be called in, maybe the town police would arrive, the man would get subdued, charged with breach of peace, put on a stretcher and sedated, and admitted to the hospital –thus the deal would be completed. Once that happened the man would not be allowed to go back to the institution.

A type of patient dumping?

Dysfunctional Pyramids of Power: Those Who Create and Sustain Them...

"Look up drama triangle in google"

I got this from a man a lot smarter that I am. By the way, my mother and father were both alcoholics -and they both died an early death. All of my parents children (3) including me are alcoholics -and I have a severe case of the disease. I had to stop drinking before my 28 birthday or die. All of us have had to stop drinking(now for decade(s)) -well, trouble helped us confront our problems.

You see problems and troubles (of course most of the normal people don't need to create trouble in order to progress) is the scacred doorway through which you can pass and build a new life. Serious problems are such a grand opportunity.

So I see a man who creates so many troubles for himself and his community -such that the world has given up on him. I can see this man giving the greatest recovery speech that the world has ever seen... maybe tomorrow, next week ...or next year...but it is there behind his current tragity.

The older I get -the less faith I have in the typical"reality" that the world has tought me. It's just the superficial outer layer.

Dysfunctional Pyramids of Power: Those Who Create and Sustain Them or A Big Dose of Your Own "Medicine"

Most of us are familiar with the Drama Triangle: Persecutor (or Aggressor), Victim, Rescuer and the tendency of human beings to rotate through those roles, in an attempt to "fix" life, for both ourselves and others. In the ideal triangle, the Rescuer is at the top of the pyramid as an archetype. That one represents the Savior or Messiah.

In dysfunctional pyramids, the Drama Triangle has shifted slightly. The Rescuer has been replaced by an Aggressor, who masquerades as the Rescuer, and the base line of the pyramid is thick with Victims, unaware of the Aggressor's hidden agenda. Should anyone become aware, of the pseudo Rescuer's hidden agenda, he, or she, will soon see that beneath the mask, lies the Destroyer of anyone who gets in his way.

The Aggressor's "game" plan is to remain at the top of the pyramid of power, by manipulating and controlling everyone beneath him. How much damage will be done to everyone else, from the top down, will depend only upon how far that particular Aggressor is willing to go, to reach, and maintain his goal. Then it becomes how much those who are beneath him, are willing to accept, before they see the truth about the Leader, and attempt to stop his "game", or escape his control.

Often, the most successful dysfunctional pyramids of power, are run by the most "charismatic" of sociopaths. These are the people who really understand the "game", and playing the game, becomes their only reason for living. It has become their addiction. Their "fix". Seeing themselves as the "winners" of the game, has become their only real identity. Everything else in their life is done, or not done, for the purpose of keeping the game intact, and themselves in position, at the top of the pyramid.

The sociopaths who get really "good" at this, are the ones who become the "Adolph Hitlers", because like all addictions, the need for an ever bigger "fix" to make oneself feel better, feeds on itself.

The manipulated group which forms the base line of the pyramid, supports and enables the Rescuer/Aggressor's power. They are sucked into the scheme, long before anyone, ever, becomes aware it has happened, or even how it happened.

The first social situation in which the sociopath learns interrelationship, as a member of a group, is in the family. Of course, it's not the only social situation. But, we all take whatever we learn in our families, out into the external world with us; into schools, workplaces, and all other social situations. There, we repeat them, usually unconsciously, as "normal" patterns of behavior. "Normal" meaning; to what we have become accustomed, and so re-enact, robot like, without any thought given as to why we do it.

Dysfunctional families are the scaled down version, of the group dynamics, which support pyramids of power. This, the place where the "game" is most often first taught, and then, passed along, generation after generation. Any member of the group, who sees the pattern of the game itself, and; protests it, tries to create a group awareness of it, or tries to change it, becomes the natural enemy of the one who runs it. The leader then deals with that challenge to his power and authority, by attempting to, and often succeeding at, turning the group against the dissident member.

Often, this is accomplished by using a Bait and Switch con. The leader sets up his "enemy", by pretending to be his/her friend. He then sets up the group, by presenting the dissident as the Aggressor. The Aggressor continues to masquerade as the Rescuer, and manipulates the group to accept his version of the Victim, as stupid, sick, or crazy. The Aggressor/Rescuer communicates ambiguously, so that no one will obtain a clear picture of what is actually occurring. The opposing versions of reality, create so much chaos and confusion, through misdirection, that the truth about what is really happening, can rarely be pinpointed. The Aggressor is always careful to keep witnesses away from his private conversations with all the participants.

This group interaction actually equates to Chaos Theory. When the starting point is not really known, the results appear to be random and unconnected. But, when the starting point is known, the results are completely predictable. The Aggressor employs the "switch" because it is unlikely, once the game gets going, that either the Victim, or the Group, will ever be able to see through the chaos. He can hide successfully in the confusion. If his true agenda remains hidden, the threat to the loss of his position, or power, is greatly reduced.

The Aggressor's goal is never that of resolution, though he will deceive the group to believe that it is, if it seems politically expedient to do so. The Aggressor's goal is to make certain that resolution does not come, for if it did, it would mean the truth about him would be revealed. If it was revealed, he would lose his position at the top of the pyramid, and the power to control everyone else.

This is the "game" of Domination and Submission. It is the abstract paradigm of all dysfunctional leaders who have a hidden agenda of obtaining absolute power and control over others.
The Drama Triangle of this dysfunctional game is actually: Aggressor, Victim, and Manipulated Group. There is no Rescuer in this perverted drama.

This game varies only in the degree of it's insanity and the concrete details which reflect the structure. The details (the players, the roles, the sets, the costumes) may change slightly, but the play remains the same. Sense, or reason, has nothing to do with it. This play, is anti-logical to perfection.

We can't reason with the leader since he will simply invalidate everything we say, do, or feel, in order to validate himself, his position, and his power. We usually can' t get the leader to just leave us alone, or "allow" "inferior" us, to disagree either. If we threaten his power, even by suggestion, we get stopped every time, for as long as he manages to hold onto the power to stop us.

The goal of the one at the top of a dysfunctional pyramid of power, is to maintain that power and his position, by keeping the system closed. That means, he must see to it that nothing inside it, gets out, and nothing outside it, gets in. "Reason" has nothing to do with it. Dysfunctional pyramids are structures of power, built without reason. The only way anyone can "win" in this insane "game" is to stop playing it, and expose the madness of the game, itself, to the light of day. To do that, you must first get outside of it, so that you can see it clearly. Once it is seen for what it really is, the mystification comes to an end, the agenda no longer hidden. No one gets sucked into a con game, if the end result is perfectly obvious from the start.

The sociopath thinks in adversarial terms. He sees life itself, as a "contest" against others, which he must "win". In religious terms, the name "Satan" means adversary. If I were to discuss this in purely religious terms, I would still mean the same thing. There is a saying about Satan, a.k.a The Devil (which you may notice is "lived" backwards) It is: Satan's arrogance blinds him to the truth about himself. Arrogant individuals maintain their position, in spite of any and all evidence that it is wrong, by projecting their own errors onto their victims. The victims' lives are "sacrificed", one way or another, to appease the petty gods of dysfunction and to maintain the perverted system.

These are the group dynamics of scapegoating. This system is supported by a blindly led majority, which enables the leader, simply because we all want to feel we "belong"; that we are part of something bigger than ourselves. I believe it appeals to the innate desire of human beings to be "One" again, to feel safe and warm within the "womb" of Creation, and to follow a Rescuer who will lead us all safely "Home". Unfortunately, when our Savior turns out to be our Destroyer in disguise, we often blindly follow him anyway, all the way to the edge of the Abyss, before we start to notice that something isn't right.

The Destroyer who masquerades as the Rescuer always has a primary rule which must be followed if you want to belong to his group. The rule is: You are not allowed to perceive any fault in the leader, or his system. If you do, you threaten his power and control, and become the enemy. If you become his enemy, he will enlist the support of the group to force you out. Then you will face the terrors of isolation, for committing the sin of awareness.

Paradoxically, the only way to see the truth about the distorted system, is to see it from the outside. So, being forced out, may be just what you need the most. At that moment, we start to regain our sanity. That is the moment we reach the nexus. Our collective "center". That is also the moment the group often believes we have "gone insane", because we see something the group does not see. It is during this period of our transformation that we "nuts" tend to laugh and giggle uncontrollably. At the complete absurdity of it all. A Cosmic Joke. If psychiatry is really interested in healing, rather than suppressing the truth nobody likes, and controlling misunderstood emotional reactions, it needs to get out of the instant judgment business, and start listening. Learn to see and hear , what has been right in front of you all along, "hidden" in plain sight.

As I said to psychiatry in 1995 ,about my own relationship with an Aggressor, masquerading as a Rescuer, "He couldn't have done it without manipulating the group to help him."
Allow a new idea to enter you own collective mind. For what is "hidden" to you, isn't necessarily "hidden" to "us". It is actually possible that "we" "defectives" understand something, that you "experts" do not. As hard as that may be for you to imagine.

It is said, the original error occurred back in the Garden, when that Old Serpent, that Snake in the Grass, pulled off the first Bait and Switch routine. He switched positions with God, in order to create doubt in the minds of the original parents, Adam and Eve. And Adam and Eve "fell" for it. We've paid for that error (which means sin) ever since, even passing it along, generation after generation, like the family heirloom. All because no fault must ever be found in the preceding generation, (or "authority" figures who represent them), even if the failure to find that fault costs us all, Life itself.

It's time we all faced the reality of that error, as the faulty premise of our reasoning. Still, who am I, to have the unmitigated gall, to dare to disagree with authority. They are right, I think. It's time I "let it go", stopped this "whining" and did something different to "get on with my life".
In MY ultimate "reality", I find myself in full agreement with psychiatry's diagnosis of me. For I am indeed, resisting, denying, non compliant, and NOW, I'm even "seeking fame". Would you say we've come "full circ

Victimhood and Victimization – the cutting edge of activism

Let talk a little about the cutting edge of innovative activism in the USA today. Jim I do realize I put you in a very difficult position in these last few months across this board.

Maybe we need to discuss the issues of my victim-hood now. What I’ve generally discovered is the people who highly dislike me, or highly admire me, these are the people usually characterize me in the most narrow terms. Well, it just ain’t me.

I grew up in a low incoming housing project. There was gangs, drugs, stealing, and that is just the beginning of the things that I participated in. I had a lot of experience with observing the results of receiving and inflicting aggressions, assaults, sabotage, betrayal…and all the rest of the gang behaviors. When I shower, I can take a look down on the side of stomach where there is a large deep life threatening knife stabbing scar.

I can tell you for a fact that most of my childhood buddies are dead, in jail, paraplegic because of gang violence, drug abuse, car crashes while DWI, or homeless. I was interrogated by the police many times –sometimes in their offices and sometimes in the back seat of their cars (beatings). Believe me I was never innocence while being interrogated in any of the forms.

I was also aware of how educated gentlemen of the establishment stole and corrupted the system. I knew people in high places kept my (mostly) name off of official documents and records, and at times I “worked” for them.

You guys can move around in your head engineering conceptual models, estimation and calculation of numbers –and I can move around the predictions and estimations of group dysfunctional dynamics -on myself, my friends, my enemies, the system and the suit coats –the detectives and newspaper people. They taught me if you are caught in an illegal act – even if coldly caught in the act with pictures –never admit that you ever done anything wrong. I have had more experience than you can imagine. I got away with much more that I disserved.

One day you wake up. Though, you never can erase the memories of your younger years. My memories of those days are almost as clear as a movie. I am haunted with my past – and I am ashamed of my behaviors. Memories of the hurt I’d seen, that I’d put in other people faces –is a jail I put myself in for the rest of my life. I also realized I was placed in a nightmare by my parents and the indifference of the culture around me. So you tell me what justice is?

Let me talk a little in my neighborhood language of years past about the methods and motives of my activities around Vermont Yankee in 1991. Let’s talk about who was assaulted and who was victimized. We will talk in symbols and images of the bureaucratic system here –not real people. It should be noted that I never reverted to actual violence throughout this period and I never will.

Have you ever watched wrestling on Tv –World Wrestling Federation (WF)? Mr. VY came walking in my turf one day. I came out from the bushes, came up quietly behind him, I blindsided him with my hardest sucker shot (punched) on the side of his head. The governor and state officials came into my neighborhood and I dropped her/them with a punch they didn’t see coming. In the ensuing mouths, they kept visiting my neighborhood and I kept dropping them with punches, which came out of nowhere. The punches were of course –the outside disclosures of internal secrets.

Then I intentionally disclosed that it was I who was assaulting you –and I kept walking up to them right in front of their faces and I continued to assault them. I said to them, you are either going to have to reform or you will have to victimize me in order to get me to stop. Do you understand, I defined their choices to two paths? I am telling you they were all dazed, bloody and bruised –and extremely fearful.

These candy asses choose to victimize me. Do you have any idea of the power with being anonymous, of creating a mystery, of acting counter to a business in the media, of transparent cultural sabotage and betrayal… and rule breaking and breaking everyones rules? Do you have any idea of the power you have in forcing them to in an underhanded manner –to turn you into a victim.

The hardest part for the whistleblower in a large institutional readjustment –is to anticipate the eventual blowback pressures of the bureaucracies, media, home and family- that will force you to cave in and prevent you from the completion of your task -in the end stage. In other words, you have got to anticipated that in they will force you to go begging for your career life and career dignity –and even your standing in your family and the community. In the end stage, you got to figure your career body is going to go begging for its last breath, wrecking any chance of institutional change. The question is –you got to set up the inertia in the opening and middle stages; such that when you eventually go begging for your final breath – the inertia, the hate, fear and anger of the system that you created that is aligned against you, will prevent them from throwing you in lifeboat. You want them to tie your up with a block of cement and throw you in the ocean. As Richard Nixon said when you end up hating your competitors, you self destruct. Like Jesus Christ said you need to love you enemies!

You drag everyone in to the drama –either in an attempt to destroy you, mostly the bureaucracy does it in an instinctual matter of survival, the media loves a mystery and people being anonymous –mostly the employees adores and loves anybody punching out management. The employees don’t care if it is justified. You end up drawing breathlessly everyone into the drama. What they don’t realize until it to late –you drag the establishment and bureaucrats extraordinarily into being knowledgeable and accountable to the dysfunctional culture. That’s what I’d done and I stepped around the whole god dammed system.

I am telling you –you have the power to interact with these institutional failures. People either hate your guts or admire you beyond belief at the end of it. Very few remain indifferent. You create a permanent image in their minds. Your name lives forever!

Jesus Christ I think did the same. Many of us framed him by his innocent victimization of the religious bureaucracy and legal system of those days. I don’t think that was true. Jesus “brutally assaulted” our limited humanity and the injustice of those days –and he cold bloodily forced the system to brutalize him. I think he tormented the men who were beating him with –you can’t hurt me, hit me harder. And the myths of Jesus life live in our minds today.

We need to look at the international disgrace concerning the Abu Ghraib prison around Baghdad Iraq with the sexual and physical abuse of the prisoners. You had young kids here involved in extraordinary events, which goes against everything they were taught here in the USA. You have to be very careful about the unconscious and conscious motives of these young kids who participated and took the pictures. In some ways, I think they staged those pictures. I am not saying that there was not cold bloody brutality going on at the prison.

This dammed thing between our ears. Sometimes we do brutal things for the shear thrill of doing it. Sometimes we model brutal behavior (illegal) in the hopes that the world will catch us –and thereby model to the world the dysfunctional systems we live under. It’s a scream for help. It’s extraordinarily potent and powerful. It has the power to change a course of an accident and change the direction of the world.

At some level they must have known those picture were going to get out to the media. Can you imagine the unconstrained power of the war machine about this, outside of accountability and laws? I know some of these Iraqis are killers and threats to American military service members? Can you imagine the torturer chamber we put our kids in, weighting the lesser evils and the bigger evils.

You see victimhood has to be interpreted very carefully. Is it retribution? Is it redemption? Is it passive? Is it brutally aggressive? Is it masochistic? Is it about a thrill?

I think the only pertinent question here –does it open up or close down the issues of your concern. Does it push the world away ---“or do you drag the world into your problem?

Therefore be careful, when you have a need to create a victim?

You must have read Mary Shelley's Frankenstein. It’s on my best books list. I see this story different than most people. The way I see it - Frankenstein is a technological advance marvel. Frankenstein ended up being the ultimate victim. Aren't we doing that today with replacing body parts and cloning, by the way! The way I see it is Dr Frankenstein abandoned his progeny in disgust; he leftFrankenstein to travel in the winds and to the ends of the earth, to grow up as it seen fit without any fatherly attention –as many of us are doing with our young children in our own lives…

I believe that is what happened with the nuclear power industry. I believe the creative best and brightest of us – have abandoned the nuclear industry to the technocrats, the legal rule makers and pencil pushers. What is left is a mournful industry that is disconnected from the world - sad and angry because they are not loved and admired. I think the utility executives have set this in motion.

Here is a recent e-mail of mine to another group. This will have a bearing with my story later on.

Not saying that at all –you have to read my comment carefully. But I think you are intentionally misinterpreting my comment for your own agenda.

The control room employees are extremely trained and skilled people. They absolutely know what is recorded–and they know the crew will be questioned later about their action –they can exactly predict what questioned will be asked. These guys are extremely intelligent–in that they can shape the disclosures of their responses to the outsider's which follows very closely what was recorded. It is easy as hell to do this because everyone is generally a lot less skilled with the plant.

After a plant scram –the crew spends a lot of time getting their story straight on their interpretation of the event and the recorded evidence. I can tell you for a fact –the control room crews are a loyal lot and tight group of individuals –very tight. They end up thinking that it is us –and the rest of the plant is against us. It is absolutely true -these outside crew people are bloodsuckers looking to make a career out of wrecking the careers of the operators.

Right, you got some 7AM to 3PM engineer or NRC inspector with very little control room experience, who comes in making a judgment against some recorded device –and the operator knows the recorded devices of the plant gives primitive information at best. Do you understand whatI mean –every scram is different from every past one–none are the same. These guys are constantly walking into the unknown –and I might add respond in a very skillful manner most of the time with the unknown. The problem is with these day shift people –they come into make a judgment with the plant in a stable condition –there is no surprises left, just the recorded event --they live in two completely different worlds.

Sitting on the "edge of time" in a control room –on that "event horizon"- on that "random generator" -is unlike any other human endeavor on this planet.

People have long asked me why I keep going over events that happened over 12 years ago.

1) Irregardless if you think I had a legitimate safety issue in 1991 in this high value and high consequence industry, there are ways you can drag the whole community and region, indeed national interest, into your area of concern. You don't necessarily have to ask any authority in order to do this. That idea is radical beyond belief.

I piss off the establishment and the managers to no ends. I also piss off the employees who sit in their helplessness. I tell them it's baloney that they can't change things, it's about just yourindifference.

I have a very difficult time writing my thoughts down on paper. I often wondered with our lost children souls of the projects –if we just figured out an incentive to get them to write down their emotions, thoughts, feelings, problems, perceptions, hopes anddreams, as they were growing up. You could head off the majority ofthe problems with these children. Could it be as simple as that? Just the idea of putting something down on paper (electrons) is radical beyond belief –it transforms yourself and it has the potential of reaching another heart. Punctuation and grammar have noworth unless there are ideas behind it.

2) For all I write about, I am still a mystery to many of you. You right, I heard that often –I express myself in a very difficult fashion. I leave people with the problem –what the hell did he mean by that and they have to choke down my bad grammar. I don't intentionally write like that. But I'll tell you it is powerful. For some people, this leaves them thinking. That part of making them think is huge. I've continue to this very moment –I interact with problems, peoples and the establishment –I get them thinking about the infinite and not some source point.

I have been involved with some pretty big issues here in NewHampshire and Vermont through the recent years outside the nuclear establishment. The establishment of this area listens to my rants very carefully and they tend to react to what I express. The Nuclear Regulatory Commission, I'll bet recognizes my interaction with the state officials and specific internal plant issues today. They wonder why the employees talk to me. I've got the NRC commissioners breathing pretty hard today.

There is an increasing recognition that the planet is in a deep crisis concerning global warming, modernization of the third world, adequate transmission and production of energy. There is no doubt in my mind that in days past, the idea that we had a choice with utilizing nuclear power is a luxury we can't afford tomorrow.

I asked some astonishing sophisticated questions of recent about the fundamental systems organizing principles of the NRC. The NRC is fundamentally a 1960's regulatory bureaucracy; it is hierarchal in a military sense; it is top down and not bottoms up; it is extremelyvulnerable to inappropriate political pressure through the tip of the organization; many of the politicians act as a gang type organization with their secrecy and hidden control to the top of the organization; a top down hierarchal organization is extremely unstable with creating long term system stability; and a top down organization has the ability to create powerful illusions against themselves and the outside organization.

So when is a top down hierarchal military organization appropriate –many organizations swing between top down and bottoms up, with the majority of the time in the bottoms up? So how does a top down organization create indifference and not caring with the lower levels of employees? How does a bottoms up organization create engagement and creativity? So what are the attributes of a bottoms up organization, What what about links and nodes? On the cutting edge of modern technological systems organization –what creates organizational stability and organization interstability as it relates to the NRC, the utilities, and all ofthe stakeholders. What role does propriety information and secrecy play in leveraging instability?

I am out to reorganize how we manage energy and I am out to reorganize the nuclear regulatory commission. These are the biggest problems this planet is going to face in the next fifty years. There are a lot of people who recognize that this has to be done now. They recognize, it is an enormous latent institutional failure –we see it in the energy shortages, price spikes up and down and across the board, unreliability of our energy distribution system across the board, and the blackouts…the enormous energy problems that repetitively knock on our doors and our political systems on this planet. All of us who has become unavailable to respond with creating the most technologically advanced system that we can think of. It’s appalling our increasing militarization of our energy cost –what a waste of money.

It is a massive active failure of all of us to politically manage the energy sector. It is mostly a failure of the voters and the public. They need to step up andbe responsible, to interact with the managing of the political sector.

I keep going back to this over and over. If you really think about the electricity sector; it's about how our educational institutions have failed to educate us –in creating our communication and understanding between of all of the complicated activities across this industry and the public interactions. We know how to create and move electrons –but we don't know how to make the system holistic to the needs of our country and planet. It's an unbelievable huge failure of ours. It's primitive in the continuum of planetary development and it goes on and on and on and on withoutchange.

Think about it! Our political system is incapable of managing the developing energy sector. This includes the so called economic system and free market, which frames how we manage energy. I would put it like this -the planetary needs of using energy are increasing at an astonishing rate –with our institutional/educational/skills ability -to manipulate and be creative is declining or remaining stagnant. Our ability to manipulate and innovate through our politics is absolutely frozen in the 1950's. Our nuclear plant sector is an example of this. How long do you think this is going to last? Sometimes I wonder that our first two milleniums of the the planets history coelesced through the constructions of our religions --with tomorrow, I think our planet will coelesced around the issues of how we make and manage energy, much like religions at our earlier times. It does give us all commonality.

It is an enormous philosophical failure within our highest principles, in how we manage the materials and intellectual resources through truth, trustworthiness, integrity, and the idea of a creative futuristic energy system in order to maintain our lifestyles and economy. I am not talking about turning us into a socialist, communist state – but something is clearly wrong with thecurrent system.

I mean I am an idiot. I sit on the outside. I can see that education drives everything---- or our institutional failures are driven by the failures of our educational system. I am absolutely astonished that I can come to that conclusion with my level of education!

Now what were the names of the sub atomic particles who seem to popin and out of the fabric of our cosmos –theorized in a complete vacuum out in outer space. We are coming to see, that the whole of our cosmos lives within a larger matrix of energy. All of us are infused in it and within it. We think of it in terms of particles–or energy of some sort. It's an illusion.

It might be looked at as in the "event horizon" of a black hole, where on the other side of this demarcation time and all our natural laws don't matter in more. I think as time goes on we will discover more and more about the fabric that holds our cosmos together –through this mysterious house of mirror. We will never find out what's at the bottom of this matrix.

It's the mystery that is so beautiful. It's called love my friends, it is outside time and undimensionless and forever. Is there a possibility of communication across this web?

We notice this is a male oriented document -all men are created equal. So here we sit with the foundation of our country being spell out with "justice for all"and "all men are created equal". It took us through the civil war and up to the mid 1960's till theAmerican apartheid was broken –and many now believe the unfairness is still with us today within the disparity of the black population.

So tell me –how come the whole of America couldn't govern ourselves according to the clear policy and laws of our lands in those times? We even had a set of laws which defined the American apartheid and backed by the supreme court.

Actually we don't worship rules and laws. We worship the ideals that all women and men are created equal throughout this planet. We all have that right because we are human and it is right. Actually we worship the ideal that the full weight of our nation’s power and might will fully protect, demand full human dignity –even to the least amongst us. I am internally grateful for our nation in every breath I can take.

Right, privilege is a word of class exclusion. I would put it as we in the United States have a responsibility to continually make sure all of our rules, laws and policy of this magnificent country, always bolsters the dignity of any human being and never decreases any amount of dignity of any of us.

The Nuremberg trail speaks to the principles that all of us have the international requirement to put ethical and moral responsibility above any national order, policy, rule and/or law.

Nuremberg Principles

The Nuremberg Principles were a set of guidelines fordetermining what constitues a war crime. The documentwas created by necessity during the Nuremberg Trials of Nazi party members following World War II. The guidelines are as follows:

Principle II. The fact that internal law does notimpose a penalty for an act which constitutes a crimeunder international law does not relieve the personwho committed the act from responsibility underinternational law.

Principle III. The fact that a person who committed anact which constitutes a crime under international lawacted as Head of State or responsible governmentofficial does not relieve him from responsibilityunder international law.qqqqPrinciple IV. The fact that a person acted pursuant toorder of his Government or of a superior does notrelieve him from responsibility under internationallaw, provided a moral choice was in fact possible tohim.qqqPrinciple V. Any person charged with a crime underinternational law has the right to a fair trial on thefacts and law.qqqqPrinciple VI. The crimes hereinafter set out arepunishable as crimes under international law: (a)Crimes against peace: (i) Planning, preparation,initiation or waging of a war of aggression or a warin violation of international treaties, agreements orassurances; (ii) Participation in a common plan orconspiracy for the accomplishment of any of the actsmentioned under (i).qqqq

(b) War Crimes: Violations of the laws or customs ofwar which include, but are not limited to, murder, ill-treatment or deportation of slave-labour or for any other purpose of the civilian population of or inoccupied territory, murder or ill-treatment ofprisoners of war or persons on the seas, killing of hostages, plunder of public or private property,wanton destruction of cities, towns, or villages, or devastation not justified by military necessity.

(c) Crimes against humanity: Murder, extermination, enslavement, deportation and other inhumane acts doneagainst any civilian population, or persecutions on political, racial, or religious grounds, when such acts are done or such persecutions are carried on inexecution of or in connection with any crime againstpeace or any war crime.

Principle VII. Complicity in the commission of a crimea gainst peace, a war crime, or a crime againsthumanity as set forth in Principle VI is a crime underinternational lawqqq
